1. Acceptance of these terms
By accessing or using MortgageCostCalc.com (the “Site”), including its calculators and its embeddable widget, you agree to be bound by these Terms & Conditions. If you do not agree with any part of them, please do not use the Site. The Site is operated by CodingBrothers (“we”, “us”).
2. Informational purpose only — not financial advice
The Site provides mortgage-related calculations for general informational and educational purposes only. Nothing on the Site constitutes financial, legal, tax, or investment advice, and the Site's output is not an offer, quote, pre-approval, or commitment to lend. We are not a lender, broker, or financial adviser. Actual loan terms, interest rates, taxes, insurance premiums, PMI, and fees are set by lenders, insurers, and taxing authorities and will differ from the estimates shown here. Always consult a qualified professional before making financial decisions.
3. No guarantee of accuracy
We work to keep the calculations correct, but we make no representation or warranty that the results are accurate, complete, or current. Every figure the Site shows is derived from the numbers you enter and from simplified assumptions — among them a fixed interest rate for the life of the loan, escrow amounts that do not change from year to year, PMI that ends at 80% loan-to-value based on the original home value, and payments made in full and on schedule. Real loans depart from those assumptions. Verify anything you intend to rely on.
4. Permitted use of the Site
You may use the Site and its calculators free of charge, for personal or business purposes, including using the results in your own work. You may share links to the Site and the scenario links it generates.
5. The embeddable widget
The Site offers a widget that can be embedded in other websites through the code the embed generator produces. Subject to these terms, we grant you a worldwide, royalty-free, non-exclusive, revocable license to embed the widget on websites you own or operate, including commercial ones. In exercising that license you agree that you will:
- embed it using an
iframepointed at mortgagecostcalc.com, rather than copying, rehosting, proxying, or re-implementing the widget or its underlying code; - leave its output and its “Powered by MortgageCostCalc.com” attribution intact and legible, and not obscure, alter, or frame them misleadingly;
- not present the widget's estimates as your own rates, quotes, or advice, or otherwise imply that we endorse, sponsor, or are affiliated with your site; and
- remain responsible for your own site — including any disclosures your visitors are owed, and any regulatory obligations that apply to you but not to us.
The widget is provided on the same “as is” basis as the rest of the Site, with no uptime commitment. We may change, restrict, or discontinue it, and may revoke this license, at any time. If we do, you agree to remove the embed code promptly. Everything in sections 2, 3, 10, and 11 applies to the widget and to anyone who views it on your site.
6. Intellectual property
The Site's design, text, and software are owned by CodingBrothers and are protected by applicable intellectual-property laws. Apart from the widget license in section 5 and ordinary personal use of the Site, you may not copy, adapt, resell, or redistribute the Site or substantial parts of it without our permission. The figures you enter and the results generated from them are yours; we claim no rights in them.
7. Acceptable use
You agree not to misuse the Site. In particular, you agree not to attempt to disrupt or overload it, access it by automated means at abusive volume, probe or circumvent its security, introduce malicious code, or use it in any way that violates applicable law or infringes anyone's rights.
8. Links to other sites
The Site links to a small number of third-party websites. We do not control them and are not responsible for their content, products, or privacy practices. Visiting them is at your own risk and subject to their terms.
9. Changes to the Site and these terms
We may modify or discontinue the Site, in whole or in part, at any time. We may also update these terms; the effective date above reflects the latest revision, and continued use of the Site after a change constitutes acceptance of the revised terms.
10. Disclaimer of warranties
The Site is provided “as is” and “as available”, without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
11. Limitation of liability
To the maximum extent permitted by law, CodingBrothers shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages — including loss of money, profits, data, or opportunity — arising out of or in connection with your use of, or inability to use, the Site, the widget, or their results, even if advised of the possibility of such damages. Because the Site is provided free of charge, our total aggregate liability to you for all claims relating to it shall not exceed one hundred United States dollars (US$100). Nothing in these terms excludes liability that cannot lawfully be excluded.
12. Indemnification
You agree to indemnify and hold harmless CodingBrothers from any claim, loss, or demand (including reasonable legal fees) brought by a third party and arising out of your misuse of the Site, your breach of these terms, or — if you embed the widget — your use of it on your own site.
13. Governing law and venue
These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. You agree that any dispute arising from these terms or your use of the Site will be brought exclusively in the state or federal courts located in California, and you consent to their jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory rules of the law of your country of residence.
14. Severability and entire agreement
If any provision of these terms is found unenforceable, the remainder stays in force. Our failure to enforce a provision is not a waiver of it. Together with the Privacy Policy, these terms are the entire agreement between you and us regarding the Site.
